This reminds me of an idea I had.  A handheld that accepts PSP UMDs, memory sticks, and GBA and DS carts.
Why?
So this handheld can play, via emulator, PSP, GBA, GB, GBC, and DS games.  Encompass the competition.  From there, you can follow the Microsoft route and make your games incompatible with GBA/DS and PSP, or you can develop a mutually beneficial relationship with Nintendo and Sony.

Another idea that works with the dual use handheld.
Sell modkits.  Make a game, and develop an editor for that game that allows you to change everything about it (or just make the editor first and the game second, whichever works).
Release the game and modkit via UMD.
Sell blank GBA/DS cartridges with USB ports, so players can download mods.
Player needs both GBA/DS cartridge with mod and UMD with original game (or some kind of security thing) to play modded game.

Modders can make mods without breaking laws, developers make money, and pirates eat shit - at least until someone cracks the encryption on the UMDs.
Everyone wins.
